Payment Terms – Category A – Full Payment With Order

Communicat provides a diverse range of products and services to our clients.

These different types of products and services are subject to specific payment terms.

 

“Full Payment With Order” terms apply to the types of transactions listed below.

Software Licences

Commercial and legal procedures require that Software Licences are issued to your organisation and are not refundable or transferable.  Therefore, payment to our supplier is required in order to activate these licences. Full payment in advance is required for all software licences.

Extended Warranties

Commercial and legal procedures require that Extended Warranties are issued to your organisation and are not refundable or transferable.  Therefore, payment to our supplier is required in order to activate these warranties. Full payment in advance is required for all extended warranties.

Service Agreements

Commercial and legal procedures require that Service Agreements are issued to your organisation and are not refundable or transferable.  Therefore, payment to our supplier is required in order to activate these service agreements . Full payment in advance is required for all service agreements .

Internet Registrations

Payment for Internet Domains (and similar permits and certificates) is required as part of the process for the Registration Authority to issue registration. Therefore, full payment in advance is required.

Internet Registration Renewals

Internet domain names and certificates are a valuable intellectual property asset for your business.  These registrations are issued for a limited and specified period. We need to pay the registration authority prior to the expiry date, to ensure continuity of your registration.

 

We are not legally permitted to renew these registrations unless we first receive your approval which is confirmed by payment and your signing of relevant agreements.

 

As far as possible, Communicat will advise you of your upcoming contract expiration, however we will not be held responsible if we are unable to contact you within the required time or if, for any other reason, we are unable to renew your registrations.

 

Our general process is that we will raise an invoice to your Communicat account or your credit card. If you do not respond to Communicat’s request, or if you fail to pay the invoice by the date payment is required then you will be at risk of your registration expiring, in which case you will forfeit your rights to the property.

If you fail to renew your registration(s) then your website or other service will become inoperative and may be taken over by an unethical/unauthorised organisation.  Communicat cannot be held responsible if you lose your registrations due to your failure to respond to our renewal approval and payment requests.

 

Please note that we also provide an option for “Auto-Renewal” (see separate agreement).

Transfer of Ownership does not take place until goods and services are paid for

Ownership of equipment, software and other goods will not pass to you until payment in full has been received by us for all amounts owed on your Communicat account.  By accepting these terms you confirm your acceptance that we may, at our discretion, register your purchases with the Personal Property Securities Register www.ppsr.gov.au.

Once goods and services have been delivered and/or provided to you then any remaining outstanding payment will be due immediately.

Additional consequence for the client not complying with payment terms.

In addition to the limitation on transfer of ownership described above, if you do not comply with the payment required herein then we reserve the right to withdraw services and recover any goods that have been provided in compensation for amounts owed.  We will not be held responsible for any damages, consequential or otherwise, which result from the withdrawal and/or removal of our goods and/or services.
